Mercy Iowa City’s dispute with its electronic medical records (EMR) software company, Altera Digital Health Inc., reached a resolution this week, when both parties consented to dissolving the agreement that was adopted in March 2021, when Mercy hired Altera to implement new software. The resolution comes after months of debate, with Mercy filing motions to compel Altera to assume its contract with the University of Iowa, and Altera seeking outstanding payment. In a court document dated Jan. 23, Mercy and Altera agreed to the following:
  • Mercy will not be obligated to pay Altera what it owed under the now-rejected agreement
  • Altera will enter a new agreement for services with UIHC, so Mercy can satisfy its closing conditions with the University
  • Mercy will drop claims against Altera, and vice-versa.
  • Altera is allowed to collect an “unsecured claim” of $6 million, and will waive any remaining amount owed
  • Altera will accept any of Mercy’s liquidation plans
A hearing is scheduled on Feb.12 to continue Mercy’s exclusivity motion, as it hashes out the final details of the case with creditors.
